I entered into a contract for a property that was misrepresented in its listing. From the outset, the seller, Brad, was unwilling to engage in negotiations regarding the price. Despite my willingness to adjust within his established budget. The seller's refusal to make adjustments stemmed from getting top market value dollar and concerns about the layout of property lines for future buyers, as the property in question was part of a 31-acre parcel being subdivided. I also would like to note that it was made very clear by Brad that he was not negotiating price and was holding the property until someone came along and gave him exactly what he wants for it. I gave him what he wanted for the 6 acres before it was brought to my attention that he was attempting to sell me a parcel on the opposite side of the property that did not match the listing.

I had already reached my financial limit at the initially agreed price for the 6 acres but continued to make concessions.
To address the seller's concerns regarding the property layout, I offered to purchase additional land. However, the seller counteroffered at a higher price, despite me already exceeding my budget. Tremendously. I now regret attempting to salvage the deal rather than just walking away initially. Although the seller’s focus was on achieving market value, the contract was based on an inaccurate listing, and I was attempting to rectify the situation.

During the cancellation process he stated that I would not receive my $500 back because we were past the closing date. He went in after I signed the new offer and changed the contingency period from 30 days to 15 days without notifying me or my realtor of the change. I spoke to my attorney and brought forth all the evidence I had including previous/ revised offers. He stated that I had a great case to take to court if I chose to pursue it and that there technically was never even a contract to begin with because of all the mistakes in it anyway.

Brad did end up giving me my rightfully owed $500 in the end and stated the reason he held onto it…

It is recommended that prospective buyers of any of the 31 acres proceeded with caution. The listing has since been updated to add an accurate outline of what he is trying to sell. Everything was done so vaguely when I experienced dealing with him and this property.
